Scope of Services and Contract Details

The upcoming contract with NBE and Banque Misr includes a comprehensive package of services: classifying seized vehicles, appraising them to determine the initial base price, as well as marketing and announcing vehicles that have become state property or for which the Public Prosecution has issued decisions to sell through public auction. These procedures aim to ensure the highest possible return for the state from selling these vehicles while enhancing transparency and oversight throughout the sales process.

Five-Party Protocol for Auction Governance

In a related development, the Public Prosecution signed a five-party cooperation protocol with the Ministry of Finance, represented by the Device for Management and Disposal of Recovered Funds and the General Authority for Government Services, along with NBE and Banque Misr. The protocol aims to govern public auction sale procedures, enhance transparency and oversight, and prevent the re-accumulation of vehicles in impound yards. An official statement from the Ministry of Finance confirmed that the protocol targets maximizing state revenues and protecting public funds, announcing the start of yard clearance and the launch of the first public auctions next July. This will allow the reuse of vacant lands for development and housing projects.

Purchase Mechanisms and Delivery Procedures

The statement clarified that the offering of vehicles at public auctions will be expanded, with tender documents available for purchase and payments processed through NBE and Banque Misr branches. Specialized committees will be formed to ensure the prompt delivery of vehicles to buyers after the sale is completed, simplifying procedures for those interested in purchasing seized cars at competitive prices. These facilitations aim to encourage citizen participation in the auctions while safeguarding the rights of all parties involved.

Legal Grounds for Vehicle Confiscation in Egypt

Egyptian law clearly defines specific cases where vehicle ownership is permanently revoked by judicial or administrative decision, within the framework of enforcing traffic laws, combating crime, and protecting public security. Although the term "car confiscation" is widely used colloquially, the law does not permit final confiscation except in specific cases stipulated by legislation or by a final court ruling, while most traffic violations are limited to license suspension or temporary impoundment. Notable cases leading to permanent confiscation include: using the vehicle for drug trafficking, committing terrorist crimes, customs evasion, driving without license plates or with forged plates, as well as cases of encroaching on agricultural land or illegal construction using vehicles.
